Tarion Warranty Corporation - No Law Suits (formerly the Ontario New Home Warranty Program): Tarion's demand that homeowners cannot launch a law suit against a builder if homeowners are to receive Tarion's assistance with warrantable issues
Background:
Ontario homeowners are required to pay a mandatory fee related to warranty protection by Tarion. However, Tarion's coverage is limited, e.g., $150,000 cap, Tarion may not warrant issues that are contractual in nature, etc.
The Issue:
Tarion has advised that if homeowners launch a law suit against their builder, e.g., for issues that are not covered by Tarion, that Tarion will not assist the homeowner, even in relation to other issues that have already been warranted by Tarion.
Canadians for Properly Built Homes' Position:
Tarion should not deprive homeowners their warranty coverage just because the homeowner is pursuing other issues with the builder through the civil courts.
